Council of Europe human rights commissioner Michael O'Flaherty warns that Europe is risking a human rights black hole. He is specifically targeting the use of offshore return hubs for migrants. He argues these centers will repeat previous mistakes without iron-clad legal safeguards. It is a classic legal shell game. Europe wants the results of border control without the pesky domestic court dates. Why bother with legal hurdles when you can just move the processing to another country? It is a convenient way to outsource the paperwork (and the liability).

echr jurisdiction still applies to member states regardless of where the hub is located.

While the ECHR maintains jurisdiction, the 'effective control' doctrine is often circumvented in practice. The actual challenge is the lack of monitoring mechanisms within third-country jurisdictions to prevent non-refoulement violations, which effectively creates the liability gap.
