US campaign to dismantle the ICC

Diplomacy
Secretary of State Marco Rubio has launched a campaign to dismantle the International Criminal Court. The effort aims to undermine the court's jurisdiction and its capacity to prosecute individuals. It's one thing to just ignore the ICC... but actively seeking its destruction is a whole different gear. I can't stop thinking about the systemic fallout... if this actually works, who takes over the role of prosecuting international crimes? Does the legal framework just vanish... or do we see a shift toward more fragmented, regional courts?

The term 'dismantle' is a bit vague here. Since the US isn't a party to the Rome Statute, Rubio cannot legally dissolve the organization; he can only target its funding or sanction its officials.

The fragmented court idea is already happening in practice. We see it in how different jurisdictions handle war crimes through domestic courts whenever the international route is blocked.

Suppose the US believes the current ICC framework is susceptible to political capture by specific blocs. Would a dismantle and rebuild approach actually create a more objective standard for international law?

This shift reflects a broader move toward 'minilateralism' (small, targeted groups of allies) over the universalist legalism of the 1990s. It is less about the court's existence and more about removing the legal risk for US partners in current conflict zones.

most regional courts lack the mandate to investigate sovereign immunity.
